Jeep issues

Like I said in my other recent thread, Ange and I got hit from the side, a few weeks back. We were heading down Old Pinevale road, to meet the surveyor at our new lot. (we picked up 3 acres about fifteen minutes out of town, to build on) Anyway, when I saw the driveway, I turned on my blinker, noticed a pickup in my centre mirror, a good 20 car lengths behind us, and proceeded to slow down to turn in. As I turned in, I heard tires scratching on gravel, and looked out my driver window to see a set of headlights bearing down on us. So I hit the throttle to get out of the way (we already had both of our front tires in the driveway by now), but by the time he hit us, both of our rear tires were only about a foot out of the driveway. We landed on the opposite side of the driveway, on the inside. If I hadn't tried to get out of the way, he would have t-boned us and flipped us over into the ditch. A ditch with an active spring running into it.

Apparently, he was passing us. Or at least that's what his insurance company told us a few days later. At the scene, he was quite appologetic, and talking forms of payment. We went so far as to get him quotes so he could pay the damages outright, before deciding on going through insurance, since the bills were in the thousands. Turns out I was ruled as %75 at fault. ****ing bullshiznit is right. He was fiddling with the radio, or jerking off or something and just ran into us. The ass knew it was his fault, but has changed his story completely, because his insurance knows how to get away with it.







Don't ask me how the window didn't pop. You can even stick your finger up between the window and quarterpanel. Anyway, we solved the problem by buying a '94 Grand Cherokee.

How does "passing" you in any way lessen his fault? :confused:

people can beleive your story i do but mine sounds like i am trying to cover my ass and am being a littleprick about the whole thing when infact i was trying to do the right thing and was caught in the wrong place at the wrong time, if it was my fault i would take full responsiblity for it like i did with my first accident

i say it was 100% his fault and that since he was not yeilding to another vehicle it should be a careless and wreckless ticket also with a failure to yield

It's frustrating, that's for sure. They say it's because I didn't shoulder check before turning. Sorry, but isn't his windshield in front of his face?

I still can't believe passing on a dirt road wouldn't automatically make him at fault. In fact, passing at all should make him at fault, since when you pass somebody you're supposed to make sure it's safe to do so. You're getting hosed. Nice GC, though (although I prefer the regular Cherokees)

Oldraven: Did you mention the fact that the person "passing you" did not flash his headlights or honk while doing so? According to Nova Scotia law he's supposed to, although absolutely nobody does it. It would kinda take away from that "didn't check over your shoulder" silliness - you could have replied with "Yeah, well, he didn't flash and honk", and then provided the young driver's handbook where it states that he was supposed to....
