Just when things start going my way...

The  city cops pull me over. Not for speeding, not for the cracked windshield, not for not wearing my sea belt, not for the loud exhaust.



They pull me over for the radio being too loud. He said he could hear my radio 150 feet away. Guess what I get a noise ordenece ticket. Guess how much $225.
COMPLETE BULL shiznit. 20 over the limit $75 making noise $225. I am getting the fealing the cops don't like me. 2 tickest for seatbelt violaton 1 parking ticket and now this shiznit.

So anybody interested in buying 2 12" subs and an amp, so I can pay my ticket.

 i have a 800W amp and 2 12" subs in a sealed box and its loud as hell in my car but when im outside the car with it sealed up its quiet but still loud. and not once have i had a ticket for that and ve had louder systems :evilgrin:

Down here, I hear they've either passed a law or are working on one to allow the police to actually rip out your stereo equipment on the spot if they so choose. So, at least that didn't happen to ya. Not much of a bright side, I guess.

I have 2 12" Memphis subs with 500rms running to them.
I have 2 6x9 Infinity Kappas with 300rms running to them.
I have 2 6.5" polk with 175rms running to them.

But that is nothing I hear car going down the road infront of my hous that will knock things off the walls in my house. Where is the police then. Of course thats right they are at the gas station protecting the soda machine.

The part about the cops at the gas station thats true. The police are always at the gas stations after 11:00pm every night and that is where you will find them till about 2:00am in the morning.

I would love to see them try and take the stuff out of my car. I wouldn't supply the tools for the job either. I would almost be impossible to take the stuff out on the sidde of the road. Becasue you would have to take half the car apart to get to most of it.

Memphis subs now i see why you said they are loud. But I told the now chief of police when he said "I could arrest you for noise violation if enough people complained". I said you can go ahead and try but you can sure kiss my ass.

"Public way" means any and all streets, alleys, sidewalks, boulevards and rights-of-way.
 
The minimum fine for a violation of this section shall be $200.00.

I think for $200 I'd try to fight it if it where me.
 
Some questions you need to ask.
Was the noise level measured by an SPL meter? When was the last time the officer visited an audiologist for a hearing test? Is the officer sure of the distance you where away when he/she could clearly hear the noise? Can the officer identify the song that was playing. Did I stop as soon as you turned on your sieren? - This would show that you clearly heard the sieren over the noise. Was the officer in or out of his/her vehicle when first heard the noise? Were the windows up or down?
 
You probably still end up paying the fine since it's your word against an officer, and the judge will usually side with the officer, but it sure would be fun trying to pick holes in that Ord. :evilgrin:
 
It's sort of like trying to get away with a speeding ticket when you weren't clocked with a radar/laser.

they can't take stereo equipment, cause it is your property and is not in itself inherently illeagal. You can always turn it down, then making it legal. They can't take your home stereo when you are load at home, they can't take your cell phone from "driving while distracted" it would be a legal nightmare if the cops ever did that. they would be sued 7 ways from sunday. I would look into where you heard that cause it will never get passed.
on the other hand, they "could" take your whole car, as the car itself was used in an "illegal" act.

So if you streaked through the center of town in all your naked glory the fine would be significantly less than if you play your music too loud?

They are also working on being able to take entire cars and auction them off if people are caught street racing.

It's frankly amazing how many people support that one.. that we're giving the government more and more ways to be able to take our property and people actually support it. Oh well, I guess they won't oppose it until there's a law to take away their property for whatever reason. (not that I support street racing in any way.. just that I think they need to find another way to deal with it)

they already can do that if you are caught drunk driving.
The reason behind that law, and how it can't be fought too hard, is that you become reckless with your car and it becomes a "dangerous weapon" and that is how they are able to take and keep possesion of your vehicle. Because it is a property that becomes the weapon, they are able to confiscate that weapon to prevent further harm. IE: if they find you with a gun, even if it is legal and registered, if they find it when you are breaking the law, they can take AND KEEP, the gun, due to it's potential harm during said crimes. it is a stretch, but with DWI and street racing you are "endangering the public health" and if an accient occurs you can be charged with assult with a deadly weapon, the weapon: your car.

so, they may not be able to take your stereo, but if you "dangerously assult" someone with your music, they can take your car.

its funny that you bring this topic up

ive been driving my TC with no catback, and as i leave my house, itll rattle a few windows its so loud, and i even admit that it was pretty  loud

well, a friend of mine has a cavalier, all he has done to it is a ler and intake, all he wanted was a little sound, the car is actually pretty quiet, along the same level as someone who puts super turbos in place of stock lers, on stock exhaust, it had a low burble to it, and HE got pulled over, we were cruising in a small group, and he got targetedm and he was the quietest

yah but a good ol' boy wont pull over detroit iron, but will harass the "ricers". Muscle cars are exempt by the cops cause they are old enough to want one them selves, but can't stand ricers.
