Some things to note here he has to have premission or probable cause to search. If you step outside the vehicle lock your door. It doesn't matter if the window is up or down he can not pass the plain of the window without cause or prermission. He is allowed to look inside all he wants from the outside. If he sees something from the outside that is probable cause he needs permission or warrant to enter a locked vehicle. Your locked vehicle becomes the same as your domicile therefor he can not enter. This has been upheld many times by the supreme court. Make sure if you are outside the vehicle you stand in front of police car as most have video cameras and it is your best witness. You can even ask to stand where you can be seen by his camera.
If you have nothing to hide think before you consent. If it's a small town you maybe painting a target on your back by refusing a search. If you continued to be harassed by local PD you can always arrange a polite meeting between the cheif and the officers.
Main thing is don't be a DICK if you respect the badge you should get respect in return.
The reason nowadays for several cars resonding is for the officers personal protection. Yeah you may think excessive force, but that responding officer doesn't know you from bad guy.

Almost***not in Kansas. Plus they couldnt find a crime and bust it if it was a murderer and shot them in the face.

The only time I ever had a vehicle searched was when I and a friend were crossing into the USA from Canada at Calais, ME. The US border guard was an absolute bell end.

Canadians are quite used to getting hassled by Canadian border officials while returning to Canada because they're scared to death a Canadian will buy cheap smokes or booze in the USA and take them home. When the CDN dollar is high it gets worse, because it's actually worth it to drive to USA to get some bargains. Going into the USA is usually never a problem. For that reason there is usually a very long lineup at USA-into-Canada crossings. I'd never even heard of anyone having a hard time getting into the USA (and for that reason there was never any line at all at Canada-into-USA crossings).

...until that trip. The border guard asked the usual questions (where are ya from, where ya going, why are you entering USA, how long ya staying), the directed me to pull over by the building. When I did another agent brought us inside while another started searching the car. I told him I wanted to be present at the search, so he brought us back out. They went through EVERYTHING. Suitcases, under seats, in all cubby holes and compartments, even in the air cleaner housing under the hood (was driving my '85 T-Bird). Mirrors under the car, sniffer dogs, the whole enchilada. I don't drink, smoke, or do drugs of any sort, so obviously they found nothing. After about an hour and a half, and with absolutely no explanation as to why we were searched, we were left to repack the suitcases and car and enter the USA. This was several years before 9/11/01, so that wasn't an excuse. Regardless, I haven't been back to the USA since.

The really weird thing is that when we returned to Canada we were expecting the typical Canadian border crossing bullshiznit, but were waved through with not so much as a second glance.

I have been pulled over for stupid reasons though:

Once I was pulled over for having an obstructed rear plate. It was covered in snow. It was snowing out. Everybody's plates were covered in snow (including the cop's, which I pointed out to him).

Another time I was pulled over so the cop could check my horn. Really. I was driving along a very busy road and noticed a motorcycle cop driving in my blind spot. I heard his siren and went to pull over. He must have gotten a little to anxious to get behind me because he almost rear-ended me and dropped his bike. He left it laying on the ground and came up to my window and asked me to try the horn. I did (it worked) and he said "that's all I need" and walked away. I left him there with his bike lying on the ground.

Another time I was driving along a 4-lane highway and saw a cop car parked on the shoulder on the other side. When I went by I saw him U-turn and come after me. I wasn't speeding so I wasn't worried (I actually didn't even think he was coming after me), but sure enough he pulled me over. As I came to a stop I rolled the window down. He walked up and said "Roll your window up". I started to, and he said "Oh, I thought you had tinted windows. Carry on" and returned to his car.

NJ has a no tint law..front windows only i believe? I dunno I wouldn't have a problem with the cops searching my car. They woulnd't find anything illegal so I woulnd't worry. I have been pulled over( in a 07 mustang for a test drive) and they cop was actualyl a pretty cool guy. The dealership saleman forgot to put the tags on teh car lol but he was just checkin to make sure it wasn't stolen. He was in his mid 20s. GOt to talkin about cars adn stuff lol. He let me go and said that I could of got a ticket and the dealership could of too.

Would you have a problem with a cop knocking on your door asking to search your house. You give him permission.He turns all the furniture up side down, pulls all the drawers and dumps everything on the floor. Then says sorry I didn't find anything and walks out leaving you with the mess. Same thing with searching your vehicle with no probable cause.

yep. had to put all my stuff back into the glove box and put other things back to where they riped them from. i made them wait and took my swwet azz time since they wasted like 15 of mine and was sure to put my seat belt on

and for tint in jersey yep no tint alowed on the front windows. most towns just write the ticket and have you pay the fine. I found out the hard way this one town didnt made me bring my car with the tint off. complete waste of the courts time. for a non moving violation.

i found out today that i should have asked for the sargent to come down if i felt so herased and mistreated. and the sgt. could have straightened the mess they made out with out them even searching. i mean they didnt even know if i had arrest warents or unpaid tickets till they ran my licence after they searched and relized i was a nobody . none the less to hell with them it's a learning expeariance and it's over . blah just another story to tell over a few beers

Never been searched... I live in a smaller town that is in a safer part of Ohio so I've been ok. Been pulled over drunk twice and never got so much as ask if I had been drinking, that was enough to scare me so I'll never do that again.

Tint laws in Ohio are the same as they are anywhere else, but down in Florida there was no tint law.

Yes... about 50 times over 3 years. The car was impounded 8 times. I was arrested about 4 times.

I've been a cop in North Carolina for the past 13 years. I can tell you guys that there may be some reasons that you are unaware of that may be getting your vehicles searched. One of the biggest things is going to be the area you are in. Is it a high crime area? Is it known for drug activity and/or prostitution? Even a public place like a Wal Mart or grocery store parking lot can be known for drug deals. I worked undercover narcotics for nearly three years and could not tell you how many people I've busted in a public parking lot. Oh and by the way, all an officer needs to search your vehicle is either probable cause or your consent. A warrant is not needed to search a vehicle UNLESS the vehicle is on private property i.e... your driveway. This is supported by hundreds of U.S. Supreme court decisions. You are not granted ALL the same rights to a vehicle as you do for your dwelling. And yes if a dog "hits" on your vehicle it will be searched WITHOUT a warrant. A dog "hit" is considered equal to probable cause (this applies to a vehicle in a public place not on private property). What is a public place? It is pretty much any street or highway and parking lot. Because a parking lot is owned by a private company or individual does not give it the equivalent to "private property". As far as how I treat people. I let them take the first step on how they want the encounter to go. Which means if you're going to be a dick to me then I'll give it right back. Any more lessons you guys would like to learn?

It IS if you do not have probable cause or consent.

Probable cause... What exactly is that? If you smell something or see something in plain sight I know you can search. What is beyond that? Suspicious behaviour? What makes it suspicious? I believe this is a very gray subject.

If you do not have probable cause you will not get a search warrant. When you apply for a search warrant you must have in writing what your probable cause is for the judicial official to review before he/she signs it. If there is no probable cause, the judicial official will not sign the search warrant. I know I have written and served many search warrants. So you would have no reason that an officer would apply for a search warrant in the situation you describe above.
