Speeding Ticket

Here's a great one for you guys and I could use any help you can provide. Saturday night I was working up in Seattle, WA - a good 180 miles away. I ended up leaving Seattle at 12AM Sunday morning for the  long drive back to Oregon. An hour into the drive, I get off the freeway to find a grocery store for some snacks. No luck so I proceed to the next busiest looking exit 10 minutes later. Get my food and I'm on my way. Continue on and set my cruise control at 70 where I-5 goes down to 2 lanes and there's a strait 70mph shot to mile marker 9. At 1:42AM, milepost 80 (85 miles so far), I get pulled over for "blowing a cop's car off the road"...and get a ticket for going 70 in a 60. :bs: Wasn't a radar check, but me passing him in the left lane as I had done to a lot of drunks that night. I prefectly well knew the car was a cop, but I didn't think I was doing anything wrong.

I continue on and see a 60mph sign so I guess I was speeding but didn't see any signs prior to that one although they're probably there. For all I know, I may have just ignored them, having travelled that path semi-frequently and seeing speed limit signs all the time for the last 80 miles. I've driven the route 4-5 times a year for the last 6 years. Anyways, I continue on and get home to rest. Turns out the county had just changed the speed limit to 60mph temporarily, for road work (that had yet to be seen), starting at mile marker 83 and continuing down to 72. So yes, I guess I was speeding. Do I think it should go on my driving record and increase my insurance rates, who don't care if its 10 over or 30 over, no. There's a lot I can use to at least fight it going onto my record, but I could sure use help on to how.

and yes I admitted to the officer I was going ~72, since I KNEW (or thought I did) the signs said 70.

Find a shop that you know well, have them write you a reciept saying your spedometer was off and is now fixed(might have to offer them come cash).  Fight the speeding ticket with that and you should be fine.

Also, in some states (works in Iowa), when you send in the money for the ticket, write the check for 5-10 dollars over, when they send you a refund check, never cash it.  Nothing will go on your record.

Also if you claim that your speedo is off...most of the time here in PA, they send you to an "official" dyno equiped place to check the speed and to fix it.  My dad had this happen with his Chevelle a while back and it was a pain for him to get it taken care of.  He had to travel pretty far just to get his speedo back to being accurate.  The police aren't stupid, they know tricks like that and have ways of dealing with it.

The way i got away with my reckless op is i took a remedial class,defensive  driving class,and court costs. It was a waste of a weekend but im not gonna bitch thats 6 points that arent on my record.

All together it came up to about 350 bucks but well worth it to keep my insurance down. Also helped me that this was my first offense

In WA if it's your first offence you can go on "probation" for a year by paying the ticket's cost in "court fees". As long as you don't get a ticket in 1 year (366 days from COURT date NOT ticket date) it simply never shows up on your report. However, if you DO get a ticket within that timeframe, you pay the fine AGAIN, and it goes on your record. Just stay safe and the year will fly on by with no sweat and no insurance jiggles;) BTW, I drive exit 255 to exit 40 and back every weekend. In fact, i drove up from 330AM till 645AM this morning. :D

What the points thing every one is talking about?

Here in Peoria county you pay the ticket $75 and $25 for a 3-4 hour class. Then it is just swept under the rug and nobody is the wiser.

Now across the rive you get probation of 3 months. If you get another ticket within 3 months both go on your record.

Well my ticket here in toledo was to the tone of 130 + court fees like 75 or something and the 75 bucks for the defensive driving what your talking about here, i have gone to the DMV and checked my record and its spotless.

Normal speeding here in toledo is like 1-6 points depending on sevrerity 6 points  being Reckless op

Moving violations are like 1-3 i believe

you have an allowance of 12 points. Once you hit those 12 points depending on how many times you have maxed your points out you may just have a 3 - 6 month suspension or possibly licence revoking i would suspose if you have repeditly hit the 12 point mark your licence would be permanently revoked.

i was always told, ignoriance (sp) is no excuse for the law.  You stated you were doing 72, the speed was 60, and you were speeding.  The fighting it thing won't work in my eyes.  just another excuse to the judge.  And the only way i see you winning is to plead not guilty and when your court date comes up use your defense as stated but without pictures your excuse isn't worth anything... take a picture of the construction sign/ mile marker signs and use that evidance to show it had changed.  It's better than going in there with an empty excuse.  And hopefully the cop will be busy the day of your court and won't appear and you will be dismissed.  Hope that helps... i'm pretty good with ohio law. ;)

The officer doesn't have to appear in court, only if subpoena'd...and yes, I know ignorance isn't an excuse. I'm not saying I'm innocent, just that it shouldn't show me as being a reckless driver for missing a recent change to the speed limit that could easily have been missed when already having travelled 80+ miles in the dark. I had stopped to get snacks...twice...just to prevent something like this, or swirving around, from happening.

Either way, care to ellaborate on this Michael? It is my first offense so this may be the easiest way to go.

Yeah, go to the courthouse and request the 1-year probation deal, I think you plead "no contest" or some  like that. I'll have to ask Audra, SHE's the one that got a ticket and had to do it:D:D

Yeah, get back to me on exactly what you have to do. I can't find any help anywhere on this thing, even the court house. What box should be checked on the ticket? A deferrel beats having to pay increased premiums.

Now if only there was a way to require trucks/trailers to better control the rocks they throw around on the road. No cracks yet but the chips are adding up down here in Portland.

You guys are lucky... I got "failure to obey officially posted signs" he never got a speed on me for some reason? But he said I was driving too fast. That ticket was BOOOOOM 110 bucks. No points, but gay none-the-less. So yah I may have the po-po after me. I mailed in my citation on the 10th day. So they will probably get it on the 15th day. So I betcha I have a warrant out for me now. PLUS the officer wrote down the wrong address after I gave him my updated paper for my house address. So if they try to find me I dont live there anymore. This could get interesting. Sorry to hijack... wish I could help you.

Lets see I live in Illinois and I got 2 tickets in the course of 6 months (me being stupid). The first one I got was for doing a burnout. $75 + $25 for a 4 hour driving class. The second one was for doing 40 in a 35 (bs ticket) $75 + $35 for an 8 hour driving class. None of these offenses goes on your record as long as long as you don't get a ticket during the year after your second offense. If you do the ticket goes on your record but the first two don't.
