Title: About therangerstation.com
Post by: igiveup on December 09, 2008, 08:28:48 PM
Hello
I am not sure where to post this on this site. Mod move it to where it should be. I just received this from Jim Oaks founder and owner of TRS.
Dear Member,
I appologize for this email. I don't normally email the members but this is an emergency.
Today, (December 9, 2008) I received a letter from the law offices of Howard, Phillips & Andersen that represent the Ford Motor Company. Ford is forcing us to surrender the name 'therangerstation.com' to them and stop using it. Ford states that using the name 'Ranger' when used in reference to the Ford Ranger is a trademark violation. In addition they are wanting me to pay them $5,000.
As you may know, The Ranger Station has been around for the past 10 years and has been a valuable resource to Ranger enthusiasts.
If Ford does this to us, where will they stop?
I have 10-days to surrender the name and pay them $5,000. I'm asking that you contact Ford online and ask them to reconsider making us change our name and prohibiting us from using the word 'Ranger'.
I am writing concerning your recent legal attacks on various "fan" websites for vehicles such as the Mustang and Ranger. I am insulted by this careless misuse of our legal system and am reconsidering any further vehicle purchases from your company until you cease and desist from any further legal action concerning this subject. I have been a Ford owner for many years and I had hoped to stay that way. These attacks are morally wrong since they are geared towards your customers, and do not instill the least bit of confidence in your brand. For the sake of your business, I ask you to please reconsider immediately.
Thank you."
Thank you for your support and I applogize for this email.
Jim Oaks TheRangerStation.com
Please express your opion to Ford. Who knows which site is next.

If I were the site owner I'd change the site to a Yogi Bear fan site...

Looks like some members of this site will need to change their names along with the name of the site. Did you all forget about that?
So, Nick can no longer be Blown Couger... he'll just have to be blown. :rollin:
Anyone with Fox, Bird, T-bird, Thunderbird, or Cougar in there screen names should change them now or risk lawsuit from the almighty Ford gawd.
Oh and you might have to remove the Cougar and T-bird smilies too...... theres gotta be some infringement in those.
shakes head... can't believe Ford is doing this....oh wait, yes I can....

Bold Moves: Ford Threatens Enthusiast Sites With Lawsuits Over Copyright Infringement
In a recent letter to enthusiast web sites, Ford's reportedly requiring the relinquishment of all Ford trademarks including domain names, banners, signs and merchandise as well as a restitution payment of $5,000 by December 19th.
The days of the Carpocalypse are upon us and Ford is now taking it to the internet, web 2.0-style. In a recent letter received by enthusiast sites including, TheRangerStation.com, Ford is requiring the relinquishment of all Ford trademarks including domain names, banners, signs and merchandise as well as a restitution payment of $5000 by December 19th, 2008.
Enthusiast sites that have received a letter from the Howard, Phillips and Andersen legal firm will be required to promptly remove all FoMoCo-trademarked material and are threatening a $100,000 lawsuit on top of the aforementioned restitution payment.
Ford claims the unofficial use of their trademarked names are damaging, which we don't buy. The one thing we would buy is the desire to keep others from profiting from the Ford brand in the form of merchandise. But we're wondering whether Ford's lawyers should really be going after enthusiast web sites right now when they need friends anywhere they can get them.
Of course, maybe we're on the wrong track of thought here — maybe we should be thinking they’re looking to make a buck any way they can? Or could Ford be concerned the leveraged-to-the-hilt logos won't be worth as much to the automaker's growing corps of creditors? More than likely it's just another case of the lawyers not understanding what the value of positive PR is.

I call BS on this. Not that I don't believe that TRS got the letter; it did, or obviously this wouldn't be such a big deal. The whole thing just reeks of extortion.
A few great quotes from the Jalopnik link say it best:
Quote
This is a scam. The lawfirm is looking for a quick buck to scare the website claiming copywright infringement. This is not the first time things like this have happened. The lawfirm threatens action, knowing that the accused can't afford the legal fees. They then demand a small monetary fee and a cease and desist order banking that the website owner will be scared into paying. Nine times out of ten, they pay the fee and the shady lawfirm makes out like a bandit. Ford could care less about therangerstation.com. I think they'd care more about the asshat that published the spyphotos of the 2010 Taurus than that shiznitty pickup that's been around for 100 years.
I hope the owner of the ranger webpage doesn't pay up.
Yep. That's basically what my gut instinct is telling me. LOL @ the "shiznitty pickup" part though
Quote
One thing to keep in mind here, is that Ford likely isn't fully responsible for this: their lawyers are. When "VW" did this to a whole host of fansites a year or two ago, it was revealed that VW didn't necessarily tell their lawyers to seek out every copyright infringement they could find, and threaten lawsuits left and right - they just gave the lawyers carte blanche, and told them that they would get a cut of whatever settlements they secured. A friend of mine who runs a German-Car enthusiast website received a similar threat, essentially told the lawyers to piss off, and never heard from them again, because it's not really worth their time to pursue insignificant claims like that. I'm betting this is a similar scenario. So while Ford should get some flak for letting their lawyers be asshats, the law firm is who we should be critical of.

Stupid Ford. RIAA tactics are not the way to win loyalty.
How astute to correlate this situation with what the RIAA does. Except we're going to assume that people paid for the cars. ;)

Screw you Ford... I'm going to get a ranger riding a mustang to restore your focus on the expedition needed to escape from the edge of bankruptcy.
That just cracked me up. :rollin:

I guess Ford really didn't learn from their failed lawsuit on Robert Lane in the early part of the decade.

I'm in active discussions with our Chief Trademark Counsel to see what the real story here is.
Next time, Jalopnik, I'd appreciate a little more professional journalism.

Well there is no judgment against him so there is no obligation to pay, and even with a judgment against you many do not pay. Ask OJ about this one LOL. If he gives them one nickel he is a fool. I say if this is how ford acts why not start a board reasonsnottobuydomestic.com.
Hey ford make some more bad business decisions build cars no one wants then expect us taxpayers to save you company. When I make a bad decision no one saves me. Maybe Ford can take our bailout money and hire a few thousand people to patrol flea markets and such to bust mom and pop who might be selling something with a logo similar to the ford logo. Keep making those good business decisions ford and no one will want to be near your logo no matter that you pay them. Maybe ford should give up internet patol and get back to attempting to build a decent car.
On a side note I started looking for my latest vehicle at a ford dealer in 2007 I tried the taurus/500, the edge and the fusion. I cared for none. I next went to Chevy and Buick and again cared for nothing I now drive a hyundai sonata v-6 SE after many tauruses, crown vics, and birds all I can say is i had no idea how good a car could be and do everything right domestics you'll probably never get me back

Actually Ford was pissed about the fact that TRS was selling decals with the Ford logo on it. The lawyers just went overboard with the scare tactics(nothing new).
The thread over on trs has been locked. this is the latest update......... via last post on that thread
A while back I had started making decals such as the old FORD tailgate letters, and offering some other decals for Ranger enthusiasts such as the Ranger windshield banner with the Ford logos on each side of it.
Although it was intended to be used as a way to keep The Ranger Station up and running and not a method of becoming independently wealthy...it was vilolating Fords trademarks.
I have talked to Scott Monty from Ford Motor Company and have agreed to:
1) Stop selling the decals since I do not have a trademark license to sell
2) Agree that the 'Ranger' is a product of Ford.
3) Not display any ads on The Ranger Station that would promote a competitor (Example: Banner ad for the new Chevy Colorado, etc)
4) Not use the site to make disparaging comments about Ford (AKA - Anti Ford Site)
5) Not turn The Ranger Station name over to anyone else.
I believe that's about it. I'm waiting from a letter from their attorney.
In return, Ford will allow us to keep The Ranger Station name and will not require that I pay the $5000.00 that the attorneys were asking for.
Scott went on to tell me that they recognize and support their fan websites and I would suggest that any other website owner/administrator reading this will be OK if they judge themselves on the items I had listed above. If you have ad banners you may want to make sure you have Fords competition filtered out.
I would like to say thanks to those that emailed Ford and spread the word. The attention and support from other enthusiats greatly helped in getting this resolved quickly.
I would ask that anyone who has posted about this on another website link the discussions here and ask that the moderator on that site lock the topic.
I also want to thank the other site owners for their support.
Not sure what is going on with the stang site though.

Thats the stupidest thing I've ever heard. Saying you have a ranger on the internet is not a crime. If I had a chevy ad, I'd tell em to screw it. They can't extort things they don't own in order to take out advertising for the competition. If I were in charge of the ranger station, I would be filing a law suit.

My opinions aside, but 88FoxBird (post #24 here) seems to sum it up.
Copyright infringement is nothing new. Just look at those being arrested for music piracy. And yet Ipods and such are for sale. Just like bongs "for tobacco use only" lol. Ford decals not sold by Ford. so on and so on.
