OK, when I made the deal with this guy to buy my XR-7, he said he would be down to give me the downpayment, then pay the rest by Jan12. Well when he came down and gave me the deposit, ($500, pretty big amount to just walk away from) he changed the date to FEB12! ok fine, I am still getting a profit for the car, so I can be patient.. but I told him "if he is not down ON THAT DATE he WILL lose the deposit".... That week comes and he calls and says he cant get a ride down till Feb24... Yesterday... again I said fine.:mad: :mad:
He was supose to call on the 23rd and never did, so I tried calling him all day, and got no answer. SO I finally left a message asking what was up, and that if he doesn't find a way to at least wire the money to me before Friday, the deal is off and he losses his downpayment and the car.:mad:
The problem is I lose mine on that mint 86 and I lose THAT car,:mad: if he tries to get more time should I give it to him, or say sorry about your luck,:toilet: :flame: and start building up the XR-7 like I planned for the 86?
you gave him more than enough time and went out of your way to try to contact him. it's his loss.
All depends on what you documented. Was the deposit in cash or check? If you can't prove that he agreed that he would lose his deposit if he didn't pick it up by Feb 12, you're open to the possibility of legal action if he can prove he gave you money.
What was documented on your deposit of the '86?
when i was selling my 81 mustang, i made up a contract.
I made up a contract for the 86, and we both have signed copies, with a witness sig... No contract for the XR-7, and it was in cash. And I believe legally you only have to hold the car for 30days before the deal is void on a deposit, and you lose it.
He gave me the original downpayment just before Xmas. Im not worried about legal action, just losing my shot at my dream car...
sounds like your right. You can wait longer if you want and keep trying to contact him but in the long run, his deal with you depends on how much of a nice guy you wanna be.
it boils down to communication as you know so if he aint putting forth responsible effort, its his problem.
It's still for sale right? If you sell it to someone before he arrives, he loses his money. If not, you apply it towards his purchase.
It sounds like you want to take his money because he's costing you another purchase, though.
That sounds totaly fair.
And I would leave him Voice Mail stating it..
"The car is going back up for sale, If you get here with the cash before somebody else buy's it I will honner our origional deal. If not you loose your deposit."
Then you just let him and the market decide
withoud a doc. good luck proving anything at all let alone a date of any sort. reguardless id have the car listed for sale everywhere. if is sells great, and i wouldnt feel bad about it. if it doesnt then sell it to him when he mopes on in with cash in hand and full payment. i certainly wouldnt let the car go anywhere till then.

Haha, I figured you would say that... lol... I have the HO and T5, and BBK ceramic longtubes sitting here Dying to go into this thing...LOL. The only problem with the XR-7 is that I will have to paint it this summer to be in the shape I want for the show season this year, where as the '86 is SPOTLESS....

Welp, I finally got ahold of the kid today, turns out he cant afford the insurance on it so he wont be getting it. Screws me for getting the money that way, but I am currently triing another means to get this car... we'll see...
